These Terms of Service ("Terms") govern your use of the Legacy Water Restoration website at legacywaterrestoration.com and your engagement of our water damage restoration, mold removal, leak repair, water extraction, and structural drying services (collectively, "Services"). By accessing our website or hiring us to perform work, you agree to these Terms.
1. Services Provided
Legacy Water Restoration provides residential and commercial water damage mitigation, water damage restoration, broken pipe repair, water leak repair, mold removal and remediation, water extraction, and structural drying services throughout the Austin, TX metropolitan area and surrounding Central Texas communities including Round Rock, Cedar Park, Pflugerville, Lakeway, Manor, and Greater Houston.
All work is performed by IICRC-certified technicians and carried out in accordance with current industry standards. Specific scope of work, materials, and pricing are set forth in the written estimate provided to you before work begins.
2. Estimates and Pricing
- Initial estimates are provided at no charge for qualifying service requests in our service area.
- Estimates are based on the visible damage at the time of inspection. Hidden damage discovered during work may result in a revised estimate, which we will communicate to you before proceeding.
- Final pricing is based on the actual work completed and materials used.
- All prices are in US dollars and subject to applicable Texas sales tax on taxable materials.
3. Payment Terms
- Payment is due upon completion of the work unless otherwise agreed in writing.
- We accept cash, check, and major credit and debit cards.
- For insurance-funded projects, we work directly with your insurance carrier where permitted. You remain responsible for any deductible and any amounts not covered by your policy.
- Unpaid balances past 30 days may be subject to a late fee of 1.5% per month or the maximum rate allowed by Texas law, whichever is lower.
4. Insurance Claims Assistance
Legacy Water Restoration is experienced in working with homeowner and commercial insurance carriers. While we will provide documentation, photos, and itemized invoices to support your claim, we make no guarantee that any specific claim will be approved or paid. You remain solely responsible for the terms of your insurance policy and any amounts your insurer does not cover.
5. Property Access and Customer Responsibilities
To perform our Services, you agree to:
- Provide safe and timely access to the affected areas of your property
- Disclose any known hazards, including asbestos, lead paint, or structural instability
- Ensure our crew can work without interference
- Keep children and pets away from active work areas
- Notify us immediately of any new damage or concerns discovered during the project
6. Workmanship Warranty
Legacy Water Restoration warrants all labor performed under these Terms against defects in workmanship for a period of one (1) year from the date of project completion. This warranty does not cover:
- Damage caused by subsequent water events, flooding, or acts of nature
- Normal wear and tear
- Damage caused by third parties or the customer
- Pre-existing conditions not addressed in the original scope of work
Manufacturer warranties on materials (flooring, drywall, paint) are governed by the respective manufacturer's terms.
7. Limitation of Liability
To the fullest extent permitted by Texas law, Legacy Water Restoration's total liability for any claim arising out of or related to these Terms or the Services shall not exceed the total amount paid by you for the specific services giving rise to the claim. We shall not be liable for any indirect, incidental, consequential, special, or punitive damages.
8. Mold Disclosure
Water damage that is not addressed promptly can lead to mold growth. While we take every reasonable step to identify and remediate mold as part of our Services, we cannot guarantee that all mold has been eliminated, particularly where mold is hidden in inaccessible areas not included in the agreed scope of work. We will advise you of any suspected hidden mold and provide options for additional inspection or remediation.
9. Website Use
The content on our website, including text, images, and graphics, is provided for general informational purposes only. While we strive to keep information accurate and up to date, we make no warranties regarding the completeness or accuracy of website content. You may not reproduce, distribute, or use our content without written permission.
10. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas. Any dispute arising from these Terms or our Services that cannot be resolved informally shall be submitted to binding arbitration in Travis County, Texas, in accordance with the rules of the American Arbitration Association. Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.
